- 1 Scope of Application, Customer Information:The following General Terms and Conditions (GTC) govern the contractual relationship between Kipli SAS (Kipli) and consumers and businesses that purchase goods through our online store. We do not recognize any terms and conditions that conflict with or deviate from our General Terms and Conditions. The language of the contract is German.

- 2 Conclusion of the Contract(1) The offers posted on the Internet constitute a binding offer to you to purchase goods. (2) You can add one or more products to your shopping cart. During the ordering process, you will enter your information and preferences regarding payment method, shipping options, etc. You accept this offer to enter into a sales contract only when you click the “Order” button. You may also enter into the sales contract by phone.

- 3 Customer Information: Storage of the Contract TextWe store your order along with details of the contract you have entered into (e.g., product type, price, etc.). However, you do not have access to your past orders via the Internet. We will send you the Terms and Conditions, but you can also access them at any time on our website. If you would like to save the product description on our store page for your own use, you can, for example, take a screenshot at the time of ordering or, alternatively, print the entire page.

- 4 Customer Information: Correction Notice:You can correct your entries at any time using the Delete key before submitting your order. We will inform you of additional correction options as you proceed through the ordering process. You can also completely exit the ordering process at any time by closing the browser window.

- 8 Limitation of Liability: We exclude liability for breaches of duty resulting from slight negligence, provided that such breaches do not concern material contractual obligations, damages resulting from injury to life, body, or health, warranties, or claims under the Product Liability Act (ProdHaftG). The same applies to breaches of duty by our agents and our legal representatives. Essential contractual obligations include, in particular, the obligation to deliver the item to you and to transfer ownership of it to you. Furthermore, we are obligated to provide you with the item free from material defects and defects of title.

- 9 Jurisdiction for Commercial Matters: The exclusive place of jurisdiction for all disputes arising from this contract is our place of business if you are a merchant.

- 10 Clause: VOLUNTARYRETURN POLICY For mattresses: When consumers purchase a Kipli mattress, we grant a voluntary 16-day return period in Germany and Austria in addition to the statutory right of withdrawal, which takes effect after the statutory right of withdrawal has expired. Returns for items delivered to Switzerland will be rejected. It is not possible to return items from Switzerland. The 30-night trial period and the 14-day return policy do not apply in Switzerland. In total, customers from Germany and Austria have a 30-day right of withdrawal—14 days under the law and 16 days voluntarily. To exercise your voluntary right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an email). However, a prerequisite for exercising the voluntary right of withdrawal is that the merchandise be returned in its entirety, in its original condition, undamaged, and without any defects. When exercising the voluntary right of withdrawal, the mattress will be picked up from the original delivery address. We reserve the right to arrange for the returned goods to be donated to a charitable organization. In such cases, the return will be considered complete once the goods have been handed over to the charitable organization and a corresponding donation receipt has been provided. If you withdraw from this contract, we must refund all payments we have received from you without delay and no later than fourteen days from the day on which we receive the returned product or a corresponding donation receipt. We will use the same payment method you used for the original transaction for this refund, unless expressly agreed otherwise with you. If we do not wish to accept a donation, or if it is not possible despite extensive efforts, we will arrange for the return shipment of the goods. Your statutory right of withdrawal is not affected by your compliance with our rules regarding the supplementary, contractually granted voluntary right of withdrawal and remains in effect regardless of this. Until the expiration of the period for the statutory right of withdrawal, only the statutory conditions listed therein apply. Furthermore, the contractually granted voluntary right of withdrawal does not limit your statutory warranty rights, which remain fully intact. We reserve the right to deny the 16-day voluntary right of withdrawal if the order is placed by an employee or partner of a mattress brand or mattress manufacturer. The same applies to individuals who are otherwise affiliated with a mattress brand or manufacturer. Also excluded from the voluntary right of withdrawal are individuals who, at the time of purchase, intentionally intend to return the mattress within the first 30 days. For example, this includes customers who change their place of residence within the first 30 days. You must make the goods ready for pickup immediately and, in any case, no later than 7 days from the day you notify Kipli SAS of your withdrawal from this contract. The deadline is met if you notify us before the 7-day period expires that the goods are ready for pickup.

- 11 Consumer Information: Participation in janoFair Weparticipate in janoFair. janoFair is an alternative to state-recognized consumer arbitration boards. If we are unable to resolve disputes arising from our contractual relationship amicably, you may use janoFair’s free dispute resolution process. The statute of limitations on any claims is suspended for the duration of this procedure. If no agreement is reached through this process, legal action remains an option.
